Welcome to the site of M&T (“we”, “our”, “us”), a restaurant and online store that provides food products and table reservations in Singapore. By using our site, located at www.m-and-t-cheese.com (the “Site”), you agree to the following terms and conditions (“Terms and Conditions”). Please read them carefully.

General Terms and Conditions

These Terms and Conditions govern the use of the Site, the purchase of products through the Site and the reservation of tables at the M&T restaurant. By accessing or using the Site, you agree to comply with these Terms and Conditions. If you do not accept these Terms and Conditions, you must refrain from using this Site or making a purchase from this Site. We may modify these Terms and Conditions at any time, and the updated version will be posted on this page with an updated “Effective Date“. You are encouraged to review these Terms and Conditions periodically.

1. About M&T

  1. Your purchase of goods from the Site is subject to these Terms and Conditions and Personal Data Protection Policy (collectively referred to herein as “Terms”). 
  2. www.m-and-t-cheese.com is a Site operated by Sunrise Premium Singapore Pte. Ltd. (“us”, “our”, “we”, “M&T”). We are a private company limited by shares registered in Singapore and have our registered office at4 Battery Road #25-01 Bank of China Building Singapore (049908). 
  3. The goods and services described in this Site are available from M&T only.
  4. You and M&T may enter into a sale contract for the sale and supply of goods described in this Site, by you making an offer to M&T via the Site, to purchase the goods at the specified price, subject to these Terms.
  5. The M&T logo and words are registered trademarks of the French company Monts & Terroirs and used under a license by Sunrise Premium Singapore Pte. Ltd.
  6. In these Terms:
    • “you”, “user” and “guest” means anyone who visits and/or uses this Site; 
    • reference to a “third party” in these Terms and Conditions includes a reference to any agent or contractor of M&T, or of any of its related entities, and any person engaged by any of them, in the creation, provision or maintenance of the Site or in the fulfilment of Orders made through the Site, and includes any of them ;
    • a reference to the Site means www.m-and-t-cheese.com ;
    • “Order” means an offer made by you in response to an invitation to treat made by M&T via the Site.

We reserve the right to revise these Terms and Conditions without notice from time to time at our discretion. Such revisions will be effective immediately upon publication on the Site. We recommend you review the Terms and Conditions for amendments each time you use the Site and before placing any Order. By continuing to use the Site after such publication, you agree to be bound by these Terms and Conditions as revised. Any changes to these Terms and Conditions will apply to any Order you place from the effective date of the change. Should we choose to provide you with notice of amended terms, you agree to receive email notification of the amendments from us or a third party. You should therefore periodically visit this page to determine the current Terms and Conditions.

2. User Agreement

  1. By accessing and/or using the Site, you accept these Terms and Conditions and agree to be bound by them, and an agreement is formed between us and you.

     

  2. Your access to the Site may be terminated at any time without notice. Your continued use of the Site following any amendment of these Terms and Conditions will represent an agreement by you to be bound by these Terms and Conditions as amended. 

3. Guest User

You may only access and/or use the Site as a guest. 

4. Legal Capacity

  1. You must be eighteen (18) years of age to purchase goods from the Site. It is strictly forbidden to supply liquor to individuals under the age of 18 through online or telecommunication services, in accordance with the Liquor Control (Supply and Consumption) (Liquor Licensing) Regulations 2015. Violators may be subject to fines of up to S$10,000. We reserve the right to request a valid photo ID for verification.
  2. Any Order and/or purchase made by you using this Site is an acknowledgement by you that:
  • You are over the age of eighteen (18) years;
  • You accept these Terms and Conditions;
  • You agree that you have entered into a legal contract with M&T in relation to these Terms and Conditions and
  • these Terms and Conditions, together with your Order, constitute the entire agreement between you and M&T for the supply of goods or services. 

M&T reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an Order to be placed, for any loss or damage of any kind M&T may suffer as a result of a transaction entered into by a minor. 

5. Orders

  1. We recommend you carefully preview any proposed Orders before adding them to your shopping cart and proceeding with your Order.
  2. Once an Order has been accepted by M&T, no cancellation of that Order is valid unless you receive our written communication permitting the cancelled Order.
  3. Representations of goods for sale made by M&T via the Site do not constitute an offer to sell but an invitation to treat.
  4. You and M&T may enter into a contract for the sale and supply of goods by you making an offer via the Site to purchase goods at the price advertised on the Site by:
    • Placing an electronic Order for the goods using the Site;
    • Confirming the Order details in accordance with the procedure on the Site;
    • You making payment in full (plus any applicable handling charges) on the Site.
    • The acceptance of that offer by M&T. 

When entering into a sale contract via the Site, you will be taken to have communicated your offer to purchase the good(s) only when:

    • any and all requirements set out in these Terms and Conditions have been met. 
    • the electronic instruction containing the offer from you enters and is recorded in our database.
    • a record is created and stored in our database.
    • M&T receives in its account full payment from you for the goods (including any applicable handling charges) and confirmation of that payment is received by our database. 

6. You acknowledge that:

  1. The transmission of your offer or the confirmation of any payment, made through an electronic instruction may not be received by M&T for reasons beyond either parties’ reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications failure, or the omission or failure of third party Site providers or systems.
  2. to the fullest extent permitted by law, M&T is not liable to you in any way for any loss or damage of any kind, however caused, arising directly or indirectly in connection with the transmission of an electronic instruction through the Site, or any failure to receive an electronic instruction for whatever reason. 
  3. M&T may act on and process all completed electronic instructions transmitted or issued through the Site without further consent from or reference to you.
  4. M&T may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions.
    • You will receive an email from M&T as soon as practicable after you have confirmed your Order and made payment. Please note this email does not constitute acceptance of your Order. If you have any questions regarding your Order you may contact us at info@m-and-t-cheese.com.  
    • If your Order is not accepted by M&T, M&T will notify you by email and arrange for a full refund of any payment made by you to be processed.
    • M&T may, in its sole and absolute discretion, accept or reject any offer made by you for any reason (or no reason), including an error in the advertised price for, or description of, goods or services on the Site, or an error of any kind in or relating to your Order.
    • Any representations made at any time about stock availability are accurate to the last known stock level and are subject to change. If M&T cannot supply particular goods, M&T will notify you by email as soon as possible.
    • Subject to this clause 6, M&T will be deemed to have accepted your Order on the first to occur : issuance of a tax invoice for the sale or the fulfilment of your Order.

7. Price

  1. Prices shown are in Singapore dollars and include GST where applicable. Prices are valid until amended or removed from the Site and are subject to change at any time.
  2. Each published saving in respect of goods is by reference to the lower of the recommended retail price of the manufacturer or the normal ticketed price of M&T.
  3. Images of goods shown without any advertised price beside that image are not offered for sale.
  4. Unless otherwise stated, accessories shown in any image of goods are not included in the price.
  5. We reserve the right to correct any errors published on the Site at any time.

8. Payment

  1. All payments must be made in full prior to pick-up of the products at the boutique, including any applicable handling charges.
  2. Payments must be made via the secure payment gateway facilities accessible via the Site and will be subject to any additional terms and conditions of these providers.
  3. To the extent permitted by law, we will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by you where a payment method is fraudulently used or is used in an unauthorised manner.
  4. If there is a problem with your payment (for example, if your credit card transaction is declined), we may contact you to make alternative payment arrangements. You will be liable for all debt collection costs where you fail to make payment for any Order when payment is due.

9. Supply

  1. Subject to you complying with these Terms and Conditions and acceptance of your Order by M&T, M&T will sell and supply the goods to you as shown on your Order confirmation.
  2. If the goods that you have Ordered are in stock M&T will endeavour to make available to the boutique Orders within the opening hours and at the time set upon ordering.
  3. When you complete your Order you will be prompted to pick up your Order at M&T boutique at the time specified upon ordering.
  4. If M&T gives you notice that it will be unable to fulfil your Order, due to lack of stock, you may cancel your Order without charge, and M&T will arrange for a full refund of any payment made by you to be processed.
  5. Supply hours are estimates only and we are unable to accept any liability for failure to make available the goods within the specified time.

10. Payment and credit card fraud

To the fullest extent permitted by law, M&T and its related entities will not be responsible for any damages or consequential losses of any kind (whether direct or indirect) suffered by a user where a credit/debit card, AliPay or WeChatPay account or other payment method is fraudulently used or is used in an unauthorised or improper manner.

11. Disclaimer and Indemnity

  1. To the fullest extent permitted by law (and without limitation to any other provision of these Terms), M&T, and each of its related entities, exclude all liability to you or anyone else for any and all loss or damage of any kind (however caused or arising) relating in any way to the Site (or any goods purchased on the Site) including, but not limited to, loss or damage you might suffer as a result of:
      • errors, mistakes or inaccuracies on the Site. 
      • you acting, or failing to act, on any information contained on or referred to on the Site and/or any linked Site. 
      • personal injury or property damage of any kind resulting from your access or use of the Site. 
      • any unauthorised access to or use of the Sites secure servers. 
      • any interruption or cessation of transmission to or from the Site. 
      • any bugs, viruses, trojan horses or other harmful code or communications which may be transmitted to or through the Site by any third party. 
      • the quality or fitness for any purpose of any linked sites.
  2. Without limitation to the foregoing, except as expressly provided in these Terms and Conditions and to the fullest extent allowed by the law, M&T and any third parties involved in the sale will not be liable for any direct, indirect, special, incidental or consequential damages arising out of your access to or use of the Site or any goods purchased on it.
  3. Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the goods on the Site. Any representation, condition or warranty which might be incorporated into these Terms and Conditions by statute, common law, the law of equity or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that any goods are suitable for your purposes. 
  4. You will at all times indemnify, and keep indemnified, M&T, and each of its related entities, including their directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by any of them arising from any claim, demand, suit, action or proceeding by any person against you or them where such loss or liability arose out of, in connection with or in respect of your conduct or any breach of these Terms and Conditions. 

12. Order Enquiries

If you have any query about the progress of your Order, please contact info@m-and-t-cheese.com. Please have your Order number handy as shown on the email confirmation of your Order.

13. Complaints

Should you wish to make a complaint, please contact info@m-and-t-cheese.com.

14. Force Majeure

M&T will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond their reasonable control, including but not limited to failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries.

15. Governing Law

The courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our Site or any Order placed on the Site, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms and Conditions are governed by Singapore law.

16. Severability

If any part of these Terms and Conditions are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these Terms and Conditions and the remaining Terms and Conditions and provisions of these Terms and Conditions will remain in force and constitute the agreement between you and M&T.

17. Transfer and Assignment

If M&T merges, sells or otherwise changes control of its business or this Site to a third-party, M&T reserves the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that M&T has collected from you and any agreements it has made with you.

18. Waiver

The failure by M&T to exercise or enforce any right or provision under these Terms and Conditions will not constitute a waiver of such right or provision. Any waiver of any provision under these Terms and Conditions will only be effective if it is in writing and signed by M&T.
